In this 50th episode of MiAI Law’s XRAISED series, “Architecture of Dissent”, Laina Chan, CEO of MIAI Law, and The Hon. Michael Kirby AC CMG, former Justice of the High Court of Australia, explore the importance of dissent in law, justice, and dissent.

Drawing from the recently published book of Judge Kirby, “Law, Justice and Other Challenges: Selected Speeches and Papers of Michael Kirby”, they exchange insights on how disagreement remains essential to the justice system, enabling progress and ensuring fairness. They highlight the importance of dissent as not just defiance but as democracy’s vital proof system. They delve into how legal research, now enhanced by AI-driven tools, allows for more nuanced, transparent, and comprehensive decision-making, making the legal process more accessible and equitable.

Judge Kirby and Laina share their personal experiences and reflections on how disagreement and alternative viewpoints can enrich legal judgments, especially in complex cases where consensus is difficult to achieve. Modern AI tools were discussed, especially how they can preserve the essence of nuance and contestability in legal thinking, ensuring that it doesn’t just prioritize speed or certainty over thoroughness and fairness.
